By accessing or using the DigiAI Wallet services, website, or mobile application ("the App"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from using the App.

1. Acceptance of Terms

By using the DigiAI Wallet services, including the mobile application, website, or any related services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you are not permitted to use the App.

2. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, images, software, and other materials, is the property of DigiAI Wallet and is protected by intellectual property laws. You may not use, reproduce, modify, or distribute any content from the App without prior written consent.

3. User Conduct and Prohibited Activities

You agree not to:

  • Attempt unauthorized access to other users’ accounts or to non-public areas of the platform.
  • Use automated scripts, bots, or tools without prior consent.
  • Introduce any malware, spyware, or harmful code into the platform.
  • Engage in any activity that could harm, disrupt, or interfere with the App or its services, including hacking, data scraping, or any unauthorized access to our systems.
  • Violate any local, state, national, or international laws, including anti-money laundering (AML), counter-terrorist financing (CTF), and Know Your Customer (KYC) regulations.

4. Privacy and Data Protection

Your use of the App is governed by our Privacy Policy, which can be found here. By using the App, you consent to the collection and use of your personal information as described in the Privacy Policy. We are committed to safeguarding your data, and while we take reasonable precautions to protect it, no system is entirely secure. You are responsible for maintaining the security of your account and data.

5. Security Features

To ensure a safe user experience:

  • All communications are encrypted using TLS 1.3.
  • Biometric authentication is available for supported devices.
  • Users receive real-time alerts for suspicious or unauthorized activity.
  • Multi-Factor Authentication (MFA) is strongly recommended.

In the event of a security breach, users will be notified within 72 hours of detection, and the scope, impact, and mitigation steps will be disclosed.

6. Incident Response

If a security incident occurs, we will:

  • Notify affected users within 72 hours of detection.
  • Disclose the scope, impact, and mitigation actions taken to address the issue.
  • Advise users to monitor their accounts and reset credentials if suspicious activity is detected.

7. Account Registration

Some features of the App may require account registration. You agree to provide accurate and complete information during the registration process and to keep this information updated.

8. Disclaimer and Limitation of Liability

DigiAI Wallet and its affiliates provide the App "as is" and "as available." We do not guarantee uninterrupted or error-free access to the platform. While we implement best-in-class security practices, no system is entirely immune to vulnerabilities or breaches. You expressly acknowledge and agree that your use of the App is at your own risk

DigiAI Wallet, its affiliates, officers, employees, and agents shall not be liable for any damages arising from:

  • Unauthorized access to or use of your account or data.
  • Any interruptions or cessation of service.
  • Malware or viruses transmitted through third-party services.
  • Errors, omissions, or inaccuracies in content.
  • Your reliance on any information or tools available within DigiAI Wallet.

By continuing to use the App, you agree that you are solely responsible for evaluating any risks associated with the use of the platform, and you release DigiAI Wallet from all liability, to the maximum extent permitted by applicable law.

9. Data Loss

DigiAI Wallet is not responsible for any loss of data, whether due to technical failures, human error, or other reasons. You are solely responsible for maintaining backup copies of any critical data.

10. Links to Third-Party Websites

The App may contain links to third-party websites. DigiAI Wallet is not responsible for the content or privacy practices of these websites. We encourage you to review the terms and conditions and privacy policies of any third-party sites you may visit.

11. Termination

We reserve the right to terminate or suspend your access to the App if you violate these Terms and Conditions, engage in unlawful activity, or misuse the platform, with or without notice.

12. Indemnification

You agree to indemnify and hold DigiAI Wallet harmless from any claims, losses, damages, liabilities, costs, and expenses, including attorney's fees, arising out of your use of the App or violation of these Terms and Conditions.

13. Modifications to Terms

DigiAI Wallet reserves the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the App. Your continued use of the App after such modifications will constitute your acceptance of the revised terms.

14. Compliance

You must comply with applicable laws and regulations, including AML, CTF, KYC, GDPR, CCPA, and other international data protection regulations where applicable.
